Register For The ASICS Fun Run NYC

Please read the waiver carefully:

I know that participating in the ASICS Fun Run NYC running club that will meet on November 14, November 21, November 28, December 5, December 12, and December 19, 2009 and related events (collectively, the “Event”), is a potentially hazardous activity that may involve the risk of personal injury and/or death and/or property damage. I hereby represent that I am in good physical condition, know of no medical or health reasons why I should not participate in the Event and agree not to enter and participate unless I am medically able and properly trained. I agree to abide by any decision of an Event official relative to my ability to safely participate in and complete the Event. I am voluntarily entering and assume all risks associated with participating in the Event, including, but not limited to, falls, spills, contact with vehicles, other participants, spectators or others, the effect of the weather, including heat and/or humidity, or cold, traffic and the conditions of the course or other areas of the Event, including congestion, all such risks being known and appreciated by me. Having read this Waiver and knowing these facts, and in consideration of your acceptance of this application, I, for myself and anyone entitled to act on my behalf, do hereby waive and release ASICS America Corporation, ASICS Corporation, Super Runners Shop 42ndStreet, Inc., Time Inc. and all sponsors of the Event, and each of their respective officers, directors, members, agents, employees and other representatives (collectively, the “Releasees”), from all present and future claims and liabilities of any kind, known or unknown, arising out of my participation in the Event, including, without limitation, personal injury or death or damage to property, whether caused by or contributed to by the ordinary negligence or fault on the part of any of the Releasees, Event participants, third parties or otherwise. In addition, I grant my permission to all of the Releasees to use or authorize others to use my name, statements (in whole or in part), any photographs, motion pictures, recordings, or any other record of my participation in the Event for any legitimate purpose (including but not limited to ASICS advertising or marketing materials) without remuneration. This Release supersedes any other agreements, written or oral, by or between the parties and is governed by the laws of the State of New York and is intended to be interpreted as broadly as possible. If any portion of this Waiver is held invalid, I agree that the balance shall, notwithstanding, continue in full legal force and effect. I HAVE READ THIS RELEASE, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT VOLUNTARILY WITHOUT ANY INDUCEMENT OR ASSURANCE BEING MADE TO ME, AND I INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. This Release is binding on my personal representatives, my estate, heirs, administrators and assigns.
